These Terms of Use (“Terms”) govern your access to and use of the Emotipal platform (“Platform”), provided by Emotipal Ltd (“Emotipal,” “we,” “us,” or “our”). By accessing or using the Platform, you (“User,” “Practitioner,” or “Client”) agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Purpose of the Platform
Emotipal is a digital platform designed to assist practitioners in generating activities, exercises, and content for client engagement and skill development.
IMPORTANT: Emotipal is a tool intended to support—not replace—the professional judgment of practitioners. Practitioners are solely responsible for reviewing, editing, and approving any activities, exercises, or content before sharing it with clients.
2. Responsibilities of Practitioners
By using Emotipal, practitioners acknowledge and agree to the following:
- Practitioners retain full responsibility for the accuracy, appropriateness, effectiveness, and safety of any content shared with clients.
- Practitioners must ensure that any content generated or adapted through Emotipal is suitable for their clients’ specific needs, circumstances, and well-being.
- Practitioners must use their professional training, judgment, and ethical standards in reviewing and delivering any activities to clients.
- Emotipal does not provide clinical, therapeutic, or medical advice. All content must be independently evaluated by the practitioner.
3. Responsibilities of Clients
Clients using Emotipal should understand that:
- Any activities or materials provided via the Platform are created, selected, and administered by their practitioner.
- Emotipal does not provide personalized advice, diagnosis, therapy, or treatment.
- Clients should consult their practitioner for any questions, concerns, or clarifications related to the activities or exercises shared with them.
4. Disclaimer of Liability
To the maximum extent permitted by law:
- Emotipal disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising out of or related to the use of content generated through the Platform.
- Emotipal does not guarantee the accuracy, completeness, or suitability of any content created or suggested by the Platform.
- Emotipal is not responsible for any outcomes, whether positive or negative, resulting from the use of activities or exercises provided by practitioners.
5. No Professional Relationship
Use of the Platform does not create any therapist-client, doctor-patient, or other professional relationship between Emotipal and any User.
6. Intellectual Property
All technology, software, designs, trademarks, and content on the Platform, except for content generated by practitioners, are owned by or licensed to Emotipal and are protected under applicable intellectual property laws.
Practitioners retain ownership of any original content they create and upload to the Platform.
7. User Conduct
Users agree not to:
- Misuse the Platform or interfere with its operation.
- Use the Platform to create content that is unlawful, abusive, discriminatory, or harmful.
- Impersonate another person or misrepresent their professional credentials.
Violation of these rules may result in suspension or termination of access.
8. Modifications to Terms
We may update these Terms at any time. When we do, we will revise the “Effective Date” above. Continued use of the Platform after any changes means you accept the revised Terms.
9. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
